GENERAL CONDITIONS OF SALE

   Article 1 - Scope
   These general conditions define the rights and obligations of the parties in connection with the reservation of stays in guest houses offered to "Un jardin al mar", Tenerife (Spain) to non-professional customers. They apply to all bookings made by phone, e-mail or internet via our booking platform. 
  "Un jardin al mar" refers to the bed and breakfast operated by its owner, Mrs Cécile Barrès, at the following address: Calle Real 13, Genovés, 38459 Garachico, Spain.

   
    Article 2 - Length of stay
    The client signatory of this contract concluded for a specified period may not under any circumstances claim any right to remain in place beyond that date.


    Article 3 - Reservation and conclusion of the contract

   

     Booking
     
The customer acknowledges that he has been aware of the nature, of the destination and booking terms available on our website and our booking platform and have requested and obtained the necessary and/ or additional information to make your reservation in full knowledge of the facts. The customer is solely responsible for his choice of services and their adequacy to his needs, so that our responsibility can not be sought in this respect. The client declares to have full legal capacity to commit under these general terms and conditions of sale and make the reservation of room (s) of hosts for his personal needs.

       Price
     
The price of one night corresponds to the rental of a room furnished and equipped with bed linen and towels, as well as its ensuite bathroom, with provision of a "continental" type breakfast served in the dining room.

   The services offered are provided at the rates in force on the website of the establishment "A garden al mar" at the time of booking . Prices are expressed in the commercial currency of the institution (euro). These rates are firm and non-revisable during their period of validity, as indicated on the website of the establishment and take into account any discounts that would be granted by the provider, under the conditions specified on this website. The prices for the reservation of services are indicated before and at the time of booking and are per room, date and number of selected people. 

        Terms of payment

      The reservation is made only after full online payment via Stripe (secure payment by credit card) or via PayPal. 
• Any reservation or payment that is irregular, inoperative, incomplete or fraudulent for a reason attributable to the customer will result in the cancellation of the reservation.
• Minimum stay : 3 nights
• Arrival time: between 4 p.m and 10 p.m (please let us know the day before your approximate arrival time and notify us in case of late arrival).
• Departure time: before 11 a.m.
• Our rooms as all the interior spaces are non-smoking. Pets are not accepted.
Respect for the calm and other occupants required.

   

      Article 4 - Conditions of modification or cancellation by the client

     
Any request for modification of the reservation must be the subject of an email addressed to the owner and its acceptance will be subject to the availability of rooms.
  Any request for cancellation must be notified by email sent to the owner of the establishment as soon as possible. In case of cancellation, the client’s refund conditions are as follows:

  Cancellation more than 21 days before arrival: full refund

• Cancellation between 7 and 20 days prior to arrival: 50% refund of the total amount.
Cancellation less than 7 days before the expected arrival date: the total amount of the reservation remains due.

In case of early departure, no refund will be made, except in cases of force majeure (natural disasters, closures imposed by the authorities, serious circumstances objectively preventing the continuation of the stay).

    Article 5 - Cancellation by the owner
 
If the owner cancels the stay booked by the client before its start, it is obliged to inform him by email as soon as possible and proceed with the full refund of the sums paid.

      Article 6 - Force majeure
​    
Force majeure means any event external to the parties, which is both unforeseeable and insurmountable, and which prevents either the customer or the establishment from meeting all or part of the obligations provided for in the contract. Each party may not be held liable towards the other party in case of non-performance of its obligations resulting from an event of force majeure. It is expressly agreed that the force majeure suspends, for the parties, the execution of their reciprocal obligations and that each party bears the burden of the resulting costs.

     Article 7 - Provision of services
    The room rental service will be provided in accordance with the following terms and conditions, as set out in these general wind conditions, which the customer has read and accepted when booking on the hotel’s website "A garden al mar".

    Capacity
   
This contract is for a specified number of persons. The owner has the right to refuse additional customers. This refusal cannot in any case be considered as a modification or a breach of the contract at the initiative of the owner, so that in the event of departure of more customers than those refused, no refund can be envisaged.

   Arrival
 
Unless otherwise expressly agreed between the parties, the room is made available to the client on the day of his arrival, between 4 p.m and 10 p.m. If the client does not physically appear, by phone or mail before 22 p.m the day scheduled for the beginning of the stay, this contract becomes void and the owner can dispose of the guest room. The amount of the reservation remains with the owner.

   Breakfast
   
Breakfast is served between 8 a.m and 10 a.m in the common dining room. This is a "continental" type breakfast (on request of the client, supplement of 2 €/person/day for "extras": hard-boiled egg, ham, cheese).

    Use of premises
 
The client is obliged to respect the peaceful nature of the premises and to use them in accordance with their destination. No meals can be taken in the rooms. The client agrees to return the room in good condition. He must declare any damage that he may be responsible for in the room or in any other part of the establishment and assume the repairs. 

  Any behaviour contrary to morality or public order will lead the owner to ask the client to leave the establishment without any compensation or reimbursement.
  The client’s personal effects left in the room or in the common areas of the establishment are his full responsibility. The establishment cannot be held responsible for loss, theft, damage or damage to said property.

 The property "Un jardin al mar" is a completely non-smoking area. The client will be liable for direct and/or indirect damages resulting from the act of smoking in the establishment. He will therefore be liable for the full amount of the cleaning and reinstallation costs of the damaged item or space. Ashtrays are available for guests who would like to smoke outside the premises. 

    Animals
 
Pets are not allowed in the hotel. In case of departure of a customer motivated by the refusal of his animal, no refund can be considered.   
   Departure
   
The room must be vacated on the morning of departure before 11 am.

    Article 8 - Owner’s liability
   
The photographs presented on our website and our booking platform are not contractual. Although every effort is made to ensure that the photographs and texts illustrating our property reflect as accurately as possible the services offered, variations may occur between the time of booking and the day of arrival. 

  In addition, the owner can not be held responsible for the non-execution or improper execution of the reservation in case of force majeure, due to a third party, including the unavailability of the internet network, the inability to access a website, or in the event of external intrusion or computer viruses.
   

     Article 9 - Claims
   
The establishment undertakes to make its best efforts to provide the services reserved by the client, as part of an obligation of means.

 

  Reservations or claims relating to the non-performance or poor performance of services shall, under penalty of forclusion, be brought to our attention in writing within eight days of the date of departure from the establishment and accompanied by all supporting documents. In the absence of complaints expressly issued within this period by the customer, the services performed will be deemed to comply with the reservation and no subsequent complaint can be validly accepted.

  The contract is definitively concluded as soon as the reservation has been made by the customer, according to the terms specified in these general conditions of sale.
   These general terms and conditions of sale as well as the customer’s reservation request express all the obligations of the parties. No specific conditions communicated by the customer may be incorporated into these general terms and conditions. 

  These general conditions may be modified and/or supplemented by the institution. In this case, the new version of the general conditions of sale by internet will be put on line by the establishment and will apply immediately for all customers.

   The fact for a natural person to book on the website of the establishment "A garden al mar" implies full and full acceptance of these general terms of sale and obligation to pay for the services ordered, which is expressly acknowledged by the customer.
